Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers and entrepreneurs via the online shop of NR 23 – Nicole Hirsch.

Deviating terms and conditions of the customer are not recognised unless we expressly agree to their validity in writing.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding invitation to order.

By completing the order process, the customer submits a binding offer to purchase the products contained in the shopping cart. The contract is only concluded upon our order confirmation or the dispatch of the goods.

3. Prices & Shipping Costs

All prices are in Euro (€) including the legally applicable value-added tax, unless otherwise stated. Additional shipping costs will be shown separately during the order process.

4. Payment

The following payment methods are available:

PayPal
Card Payment (Debit Card / ATM Card)
Instant Transfer (Sofortüberweisung)
Prepayment by Bank Transfer

Payment is due immediately upon conclusion of the contract. In the case of prepayment, dispatch will only take place after full payment has been received.

5. Delivery

Delivery will be made to the delivery address provided by the customer. Delivery times are product-dependent and are indicated in the shop. Should delivery delays occur, we will inform the customer as soon as possible.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal. The complete withdrawal policy can be viewed on our separate withdrawal page.

8. Exclusion of Withdrawal

The right of withdrawal does not apply to:

Sealed goods for reasons of hygiene or health protection if the seal has been removed
Products custom-made or personalised

This particularly applies to our fragrance products, fragrance sticks, and fragrance cartridges.

9. Warranty

The statutory warranty provisions under Austrian law apply.

10. Liability

We are liable without limitation for intent and gross negligence. For slight negligence, we are only liable for the breach of essential contractual obligations. No liability for improper use of the products.

11. Applicable Law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer protection regulations of the country of residence continue to apply.
